Director, Products Liability

Mr. Asfendis concentrates his practice on defending products liability claims. He represents a broad base of product manufacturers and distributors, as well as companies large and small in business litigation and contractual disputes. He is also a member of the firm’s E-Discovery Task Force and regularly counsels clients on e-discovery-related issues. A member of the state and federal bars of New York, Mr. Asfendis litigates throughout the United States.

Mr. Asfendis also has extensive experience handling a wide variety of non-product litigation matters, including complex contractual and other commercial disputes, New York Labor Law claims, automobile and general negligence claims, insurance coverage, and subrogation. He has considerable appellate experience including appeals before New York’s appellate courts, as well as the U.S. Court of Appeals for the First, Second, and Third Circuits.

Products Liability

Mr. Asfendis has defended product manufacturers and distributors in products liability matters throughout the United States, including matters involving medical devices and instruments, emergency medical services equipment, chemical products, pharmaceuticals, automobiles, and power tools, to name a few. He concentrates his practice on medical device litigation and has litigated both in the individual lawsuit and mass tort context. He also has considerable experience defending clinical laboratories in matters involving the disciplines of anatomical and clinical pathology, genetic testing, and cervicovaginal cytology.

Electronic Discovery and Information Management

As a member of the firm’s E-Discovery Task Force, Mr. Asfendis regularly counsels clients on a variety of related issues, including issuance of legal holds, preservation and collection of electronically stored information, record management and retention policies, and electronic business communications. He has served as lead e-discovery counsel in a large mass tort litigation involving claims of product defect asserted against a leading medical device manufacturer.
