Speaker, The 15th Annual E-Discovery Conference, "In This Together: Attorney's Shared Responsibility with Their Clients to Understand ESI"

The joint obligations of attorneys and their clients as they relate to discovery have perhaps never been in sharper focus. The ABA Model Rules of Professional Conduct impose on lawyers an affirmative ethical responsibility to “keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology.” This panel will discuss ethical considerations in-house and outside counsel must consider in working collaboratively to ensure that their e-discovery practices are airtight, including the need to stay abreast of developments in technology and the balance between a client’s desire to reduce legal costs and outside counsel’s need to stay actively involved in the discovery process – and the risks involved in not doing so. Panelists will provide practical guidance from their hands-on experience to help navigate these rough waters.
