In the aftermath of the U.S. Supreme Court’s decision on affirmative action in higher education and the associated backlash against DEI initiatives across the nation, a troubling question keeps surfacing: Will the future of DEI be a repeat of the past? As the profession contemplates the impact that technology and the multigenerational workplaces will have on the practice of law, how will the quest to correct historical and systemic inequities rebound? Will age-old injustices simply replicate in new contexts, or is there an opportunity for real breakthrough?
