Social media information continues to be a hot button issue in litigation, as attorneys must grapple with the questions of how to get it and how to potentially use it. Preservation and production difficulties abound, and the ethical issues that arise in the context of social media discovery only add to these challenges. It is critical for attorneys to be informed of the various platforms and their intricacies to be able to properly advise and litigate on behalf of their clients.
