Social media information continues to be a hot button issue in litigation, as attorneys must grapple with the questions of how to get it and how to potentially use it. Preservation and production difficulties abound, and the ethical issues that arise in the context of social media discovery only add to these challenges. It is critical for attorneys to be informed of the various platforms and their intricacies to be able to properly advise and litigate on behalf of their clients.
This Gibbons Academy will discuss:
- drafting effective social media discovery requests;
- third-party subpoenas requesting social media information;
- potential sanctions/spoliation motions pertaining to social media; and
- authenticating social media information.
The panel will also provide practical advice for avoiding ethical pitfalls commonly associated with social media discovery.
