Mr. Wolak chairs the firm’s Privacy & Data Security Team and has extensive experience with a broad range of privacy and security issues. He regularly provides advice and counsel on compliance with the ever-evolving local, national, and global regulatory regimes; leads incident/breach response investigations and post-event activities; develops and implements written privacy and security policies; and completes privacy and security assessments. In addition, Mr. Wolak assists clients with cyber insurance coverage, policies, and endorsements; best practices to mitigate cyber risks and exposures; due diligence for regulatory compliance; and data security training for employees.
Mr. Wolak also has extensive experience representing clients on insurance coverage matters. He has been included on the Best Lawyers® list for Insurance law, including its “Lawyers of the Year” list (Newark, NJ), as well as the New Jersey Super Lawyers list for Insurance Law. For more than 25 years, he has litigated matters involving hundreds of millions of dollars in insurance coverage for a broad range of clients and regularly provides strategic counseling and analysis of potential risks and exposures, policy terms and conditions, and claims resolution.
Prior to joining Gibbons, Mr. Wolak served as a law clerk to the Honorable Nicholas H. Politan of the United States District Court for the District of New Jersey.

Privacy & Data Security
Mr. Wolak regularly counsels clients on compliance requirements under international, federal, and state privacy and security statutes and regulations, including the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), Health Insurance Portability and Accountability Act (HIPAA), and other regulatory regimes. He also works with clients on incident and breach prevention, detection, mitigation, and response, including interacting with regulators and law enforcement, fulfilling notification obligations to impacted consumers, and meeting contractual obligations to third parties. Clients also rely on his experience with privacy and security issues to assist in developing and implementing information security plans, incident response plans, data retention policies, internal security policies, and e-commerce policies. Mr. Wolak is a frequent speaker and author on privacy and security topics, as well as insurance coverage for first party and third party losses that may arise in the event of a data security incident or breach.
Insurance Coverage Litigation and Counseling
Mr. Wolak has extensive experience handling a broad range of insurance coverage disputes, including claims involving directors and officers liability, employment practices liability, construction defects, environmental and toxic tort coverage, business interruption and extra expense, and professional errors and omissions. A wide variety of clients, including pharmaceutical and chemical manufacturing companies, educational institutions, financial services companies, telecommunications companies, professional service providers, and insurance companies, rely on Mr. Wolak’s experience and advice to achieve their objectives and resolve both insurance coverage matters and commercial disputes. Mr. Wolak litigates disputes in state and federal courts in New Jersey, New York, and Delaware, as well as in domestic and international arbitrations. He has also been retained as an expert witness/consultant on insurance issues and is a frequent speaker on insurance law topics.
