Gibbons P.C. is pleased to announce that Raymond N. “Rusty” Pomeroy has joined the firm as a Director in the Environmental Group, resident in the New York City office.

Mr. Pomeroy is an experienced environmental attorney and risk management professional with a broad, multifaceted skill set developed in both private practice and in-house counsel roles. He is known for his pragmatic approach to problem-solving and is frequently credited by his clients for his ability to distill complex environmental issues into understandable and actionable concepts. His extensive track record involves identifying and mitigating environmental risks in complex commercial transactions – including real estate acquisitions, sales and leases, mergers and acquisitions, loans and loan foreclosures, and commodities contracts – as well as in the remediation and development of contaminated sites. He regularly advises clients on environmental insurance review and placement, corporate environmental policies, procedures and disclosures, climate change and green and sustainable energy issues, project and facility permitting matters, and environmental compliance and litigation. Mr. Pomeroy is a frequent speaker and writer on matters involving climate change, the rise of ESG reporting and disclosure rules, and building energy performance requirements, including New York City’s Climate Mobilization Act.

Mr. Pomeroy has counseled clients with regard to remediation, brownfields, and Superfund projects undertaken in accordance with New York’s Brownfields Cleanup Program, New Jersey’s Industrial Site Recovery Act, New Jersey’s Site Remediation Reform Act, and New York City’s Voluntary Cleanup Program. Additionally, he is an experienced litigator in Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and state-based cost recovery, toxic tort claims, and challenges to actions by administrative agencies and government regulators.

Prior to joining Gibbons, Mr. Pomeroy served as special counsel at Stroock & Stroock & Lavan LLP in New York City. A Fellow of the American College of Real Estate Lawyers, he has been listed in both Woodward White Best Lawyers® and Chambers Environment – New York.

Mr. Pomeroy earned his J.D., cum laude, and Environmental Certification from the Elisabeth Haub School of Law at Pace University, where he was the Executive Articles Editor for the Pace Law Review. He holds a B.A. in political science from the State University of New York at Albany. He is admitted to practice in the states of New York and New Jersey and the U.S. District Courts for the District of New Jersey and the Eastern, Southern, and Western Districts of New York.

“I’m delighted to be joining the outstanding Environmental team at Gibbons. At the end of the day, it was about finding the right fit for me and for my clients. The depth and breadth of Gibbons’s practice groups provide a great platform for me to serve my clients, build on existing client relationships, and develop new ones. I couldn’t be more excited to join the team,” said Mr. Pomeroy.

“We are excited to have Rusty join our Environmental Group and further enhance our presence in New York City,” remarked Camille V. Otero, Group Chair. “With his broad background and extensive experience in environmental law and complex commercial, corporate, and regulatory matters, he will provide our clients with superlative counsel to meet their environmental legal needs.”
