The Supreme Court’s decision has been issued in the West Virginia v. EPA case, concerning challenges to the Trump EPA’s Affordable Clean Energy (ACE) rule, including the scope of EPA’s authority to regulate greenhouse gases from the power sector. This CLE will provide background on the case, discuss the Court’s decision, and offer thoughts on what the decision means for (i) EPA’s efforts to limit power plant pollution, and (ii) administrative law in general. The presenter, Michael Myers from the New York State Attorney General’s office, argued before the D.C. Circuit in the case below challenging the ACE rule and in the litigation over EPA’s previous rule, the Clean Power Plan. Matthew J. Sinkman, Counsel at Gibbons P.C., will provide an introduction and moderate the program.
