The Small Business Reorganization Act of 2019 provides an additional option for small business debtors to reorganize their business and financial affairs. While many Subchapter V debtors share similar characteristics, the bankruptcy code affords debtors some latitude in proposing and confirming plan terms that fit the specific circumstances of an individual case, and negotiations with creditors may lead to a variety of creative solutions. This session is designed to provide Subchapter V Trustees with an overview of the types of provisions that parties might seek to incorporate into a plan to further assist Trustees as they carry out their statutory obligation to “facilitate” consensual plans.
