As we enter the second decade after the landmark Zubulake opinions, the rapid advancement of information technology, the “Internet of Things,” and new sources of evidence are making it challenging for attorneys to meet their ethical responsibility to be “tech savvy.” This panel will discuss recent pronouncements on these issues by the ABA and the California Bar’s Committee on Professional Responsibility and Conduct, and posit modern-day ethical dilemmas that will impact the current and future practice of law.
