Without much fanfare, the ABA’s Commission on Ethics 20/20 has proposed significant rule and comment changes to its Model Rules of Professional Conduct focusing on the digital practice of law. These proposed changes finally recognize that the practice of law has undergone a digital transition – and that technology affects attorneys and clients in litigation, business, and personal endeavors on a daily basis. What are the changes, do they really reflect “new” obligations, and if so, are they too little too late?
