The current NLRB has not hesitated to revert to well-established positions on a variety of key issues to better level the playing field. This discussion will address the Board’s current position on several of these issues, which impact both union and non-union employers, and potential future challenges, including:
- Whether your workplace policies are lawful
- Whether you can require employees to keep workplace investigations confidential
- Whether you can limit your employees’ use of your computer systems to business purposes only
- Whether you are a joint employer
- Whether an individual is an employee or independent contractor
- What constitutes protected concerted activity
- What rules apply to union elections
- What changes there have been to the collective-bargaining process
