As more and more people document all aspects of their personal and professional lives on various social media platforms, and companies increasingly use social media as a marketing tool, the need to search for, capture, and use social media in an ethical and defensible manner in litigation is a growing concern. This panel will explore hot topics in social media, including the preservation and collection of social media evidence in a forensically sound and properly authenticated manner, and best practices for ensuring that searches for an adversary’s social media do not run afoul of ethics rules.
