A deposition is one of the most common and important litigation activities. Because so many cases are resolved by motion or through settlement before trial, the deposition may be the only opportunity a lawyer has to directly question a witness or defend a witness being questioned. The deposition process is often critical and can make or break a case. With proper preparation, it can also be the most fun a lawyer will have in a litigated matter.

This presentation will discuss how to:

  • prepare for a deposition;
  • deal with preliminary matters and use exhibits;
  • develop or enhance the skills required to effectively take and defend depositions;
  • prepare witnesses for depositions; and deal with opposing counsel.
