The program will discuss the negotiation and drafting of E-Discovery protocols and guided by recent case law, specific technological and practical issues that can be addressed in protocols to reduce future discovery disputes. The program will include a practical discussion of strategies for formulating a protocol that balances the needs for flexibility in litigation (as discovery progresses) on one hand with the need for confidence on the other hand in knowing that litigants will not be forced to re-do or duplicate their efforts at a later point. For example, the program will include a discussion of protocol provisions that address review methodologies such as TAR and email threading, reasonable limits on the scope of discovery in light of emerging data sources (especially with the explosive growth of WFH during COVID-19), the ability to redact irrelevant information, and inadvertent disclosures of protected information.
