This CLE presentation will focus on recent developments in state law, as well as federal and state case law. The discussion will highlight key cases, explain the court’s decisions, identify topical issues, and provide strategic takeaway points.

At this presentation, the panelists will discuss:

  • A recently passed NJ law concerning derivative proceedings and shareholder class actions;
  • A District of New Jersey case involving the issue of venue and the motion to transfer;
  • A Third Circuit case on the waiver of arbitration due to the delay in demand of such arbitration after litigation was underway; Fed. Rule of Evidence 502(d) Orders to protect against waiver of attorney-client privilege or work product protection; and
  • A recent case addressing sanctions for discovery abuses under F.R.C.P. 26(g).
