Mr. Klock is certified by the New Jersey Supreme Court as a civil trial attorney who has tried, among the 58 completed trials he has handled, numerous environmental and construction cases. He handles contract drafting for remediation contracts and other complicated construction projects. His work in the environmental transactional area includes wetlands, Toxic Substance Control Act (TSCA), Resource Conservation and Recovery Act (RCRA), Clean Water Act (CWA), The Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Clean Air Act (CAA), Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), and Occupational Safety and Health Administration (OSHA) issues. In addition, Mr. Klock represents commercial and institutional clients in the condemnation process. Prior to his legal education, Mr. Klock was an engineer with the Port Authority of New York and New Jersey, working on the construction of the “bathtub” or hydrogeologic barrier on the original World Trade Center. He also worked on additional construction projects.
Mr. Klock utilizes his engineering background to handle complex environmental remediation projects including those under the Brownfield Site Remediation Act, where he has drafted construction contracts and agreements with remediation contractors, treatment works, and transporters. He has interfaced with regulators at the United States Environmental Protection Agency, the New Jersey Department of Environmental Protection, and New York State Environmental Conservation as well as other state regulators, on these projects, which he has brought to successful conclusion.
In the construction area, Mr. Klock has litigated cases involving construction projects for major corporate facilities in New Jersey, New York, Texas, Louisiana, and Michigan concerning matters alleging design defects, construction defects, and delays. He has also represented contractors and subcontractors in many similar matters.
In the condemnation area, Mr. Klock has represented numerous governmental entities and private companies. For example, he has been eminent domain and environmental counsel to New Jersey Schools Development Authority in Essex, Passaic, Hudson, Mercer, and Union Counties, involving acquisition of lands for high schools, middle schools, and elementary schools. He has also represented New Jersey Meadowlands Commission as counsel in similar mixed environmental/eminent domain valuations, with complex environmental problems. He has also represented many private parties in condemnation matters.
The scope of his representation often includes relocation of tenants and businesses. Relocations have been done under the federal relocation act when federal law has been in play, such as in matters involving HUD tenants. Thus, Mr. Klock has had to comply with the Uniform Relocation Assistance and Real Properties Act. He has had many state property owners relocate under the New Jersey Relocation Assistance Act. Some of the relocations have been quite complex, including, for example, a medical business employing dialysis units and a large plant providing most of the squid supplied to the eastern United States. While many properties were negotiated, several were submitted to Condemnation Commissioners and jury trials for valuation. In addition, Mr. Klock has filed cost recovery actions for condemnors after remediation of the properties.
