Ms. Oks handles a wide range of complex business and commercial litigation matters in both state and federal courts throughout New Jersey and New York. Her practice focuses primarily on various aspects of general and complex commercial litigation, including factual investigation, discovery and strategy, briefing and motions practice, and appellate filings in connection with class action defense, common law fraud, breach of contract, business torts, and multi-party construction disputes.

Areas of Focus

Consumer Class Action Defense

Ms. Oks devotes the majority of her practice to representing companies in federal and state trial and appellate courts in defense of class action claims asserted under a variety of federal and state consumer protection statutes, including state consumer fraud and unfair and deceptive practices statutes.

Complex Commercial Litigation

Ms. Oks has experience resolving a broad variety of business and commercial-related disputes representing public and private companies. She practices in both federal and state trial and appellate courts, as well as in a full range of alternative dispute resolution arenas. Representative clientele include major insurance companies, building and construction product manufacturers, food and beverage manufacturers, multi-national industrial companies, and a multi-state natural resource company.

Healthcare & ERISA Litigation

Ms. Oks advises clients on issues in the ERISA, HIPAA, and emerging healthcare technology fields. She has represented a major ERISA benefits administrator and carrier for a number of years, handling matters of statewide and national importance and litigating a series of high impact issues, including cases that concern coverage for so-called “extension of practice” unlicensed surgical facilities, waiver of co-insurance/co-pay by medical providers, and “usual and customary” rates for reimbursement. Ms. Oks also has experience functioning as outside general counsel for her healthcare industry clients, including payors, providers, and healthcare technology companies with particular attention to digital health and health innovation, counseling them in the full range of contractual matters, including review of vendor contracts and physician contracting arrangements, compliance, and corporate matters, as well as resolving pre-litigation disputes.

Electronic Discovery & Information Management Counseling

Ms. Oks is a member of the Gibbons E-Discovery Task Force. She is frequently called to serve as the e-discovery liaison on cases within the firm and regularly publishes about key developments and important cases in the law of electronic discovery. She is also an editor of the Gibbons Law Alert blog, with a particular focus on content related to developments in electronic discovery.
