Ms. Otero focuses her practice on environmental and toxic tort litigation, representing clients in an array of environmental matters involving the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), Resource Conservation and Recovery Act of 1976 (RCRA), and the Spill and Landfill Closure Acts. She has extensive experience assisting clients in remediation activities and compliance, environmental due diligence, and corporate and real estate transactions. She has also represented clients in matters related to petroleum franchise law and toxic tort litigation arising from petroleum contamination.


The components of her practice include:

  • Litigation arising from the spill, release, discharge, and/or migration of hazardous substances into the environment, as well as enforcement proceedings concerning permit and other violations and alleged non-compliance with Administrative Consent Orders, including all aspects of litigation, from drafting pleadings and developing case strategy to conducting discovery and presenting oral argument at motion hearings
  • Negotiation of settlement agreements between private parties and Consent Decrees with the NJDEP and USEPA

  • Works with clients' in-house environmental and technical personnel and outside environmental consultants on investigation and remediation of contaminated sites
  • Assists clients with troubleshooting and facility compliance issues
  • Conducts due diligence investigations in real estate transactions
