Gibbons Attorney Contributing Content to Latest New Jersey Environmental Law Handbook

Susanne Peticolas, a Director in the Real Property & Environmental Department of Gibbons P.C. recently contributed content to the 8th edition of the New Jersey Environmental Law Handbook. Ms. Peticolas penned a section entitled “Bankruptcy and Environmental Claims” discussing the issues created by the conflicting policies underlying bankruptcy law.

Ms. Peticolas’s section covers a wide range of relevant topics, including which environmental claims are bankruptcy “claims” and how environmental claims are impacted by the automatic stay, the identity of the claim holder, and the relief that is being sought. Her section discusses the issues created by the conflicting policies underlying bankruptcy law, focusing on a fresh start for the debtor, as well as environmental law, which focuses on making the polluter pay.

At Gibbons, Ms. Peticolas handles environmental litigation and toxic tort litigation. She represents clients in Superfund cases as well as in companion personal injury and property damage matters. Ms. Peticolas also has extensive regulatory experience before administrative boards and agencies on air, hazardous waste, water, and noise pollution matters. She counsels clients on general regulatory compliance questions, including issues relating to RCRA, TSCA, OSHA, and reporting requirements under the New Jersey Spill Act and other environmental statutes and regulations.
