Mr. Brooks brings his background as a former Deputy Attorney General and in-depth experience with the regulatory process to his comprehensive environmental practice. He serves on the Executive Boards of both the Environmental Law Section of the New Jersey State Bar Association and the Justice Stewart G. Pollock Environmental American Inn of Court. He concentrates his practice in the area of environmental law, especially regulatory compliance and remediation, transactions, and litigation under applicable state and federal environmental statutes and regulations.


Mr. Brooks counsels clients and negotiates with government agencies in connection with various regulatory requirements under both federal and state environmental statutes. These requirements may involve operational permits related to discharges to the air, surface water, or ground water, or to the handling or disposal of hazardous substances. In addition, he regularly assists clients with New Jersey Department of Environmental Protection (NJDEP) land use permits and approvals related to wetlands, flood hazard areas, waterfront development, and tidelands.

Mr. Brooks also assists clients with regulatory issues related to the remediation of hazardous substances in the soil, surface water, ground water, and sediment, as well as vapor intrusion. He counsels clients in connection with remediation projects pursuant to the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) and the Resource Conservation and Recovery Act under federal law, as well as the New Jersey Spill Compensation and Control Act (the “Spill Act”) and Site Remediation Reform Act (SRRA) under New Jersey law. In connection with the SRRA in particular, he has extensive experience working with licensed site remediation professionals.

Mr. Brooks regularly negotiates and drafts environmental liability apportionment clauses in real estate contracts and corporate transaction documents. He also assists clients with environmental due diligence and, if applicable, compliance with the requirements of the Industrial Site Recovery Act (ISRA).

Mr. Brooks represents clients in private-party cost recovery litigation pursuant to both CERCLA and the Spill Act and in defense of claims for Natural Resource Damages initiated by the NJDEP. He has appeared in both state and federal court on such matters. Mr. Brooks also has experience with environmental insurance coverage matters.
