Nancy A. Lottinville
Nancy A. Lottinville’s real property practice is fully engaged in all areas of land use development and governmental permitting as well as in multiple aspects of transactional real estate.Ms. Lottinville’s land use practice involves representation of development applications before municipal, county, state and regional governmental authorities in a wide range of land development uses including manufacturing, office, warehouse, restaurant, hotel, medical and residential. She has prosecuted multiple prerogative writ appeals on behalf of both developers and objectors including drafting complaints, briefs, motions through oral argument. Her litigation experience includes challenges, in trial and appellate courts, to municipal actions taken in contravention to conservation easements and challenges to the actions of condominium boards in violation of operating documents.
On the municipal side, Ms. Lottinville counseled the Planning Board of Highland Park for many years on an extensive range of legal issues, has been engaged in the preparation of municipal zoning ordinances and multiple master plans and has successfully defended prerogative writ challenges. In the redevelopment area, Ms. Lottinville guided the municipal board through the legal requirements of the needs determination process in an extensive downtown redevelopment plan involving over sixty properties in the municipality’s main street redevelopment plan, and successfully defended the Planning Board’s determination of need in subsequent litigation.
Ms. Lottinville has conducted extensive zoning due diligence investigations and authored zoning due diligence reports in support of complex financing and title transactions involving office, multiple office building complexes, hotel office complexes, electrical generation facilities, manufacturing facilities, and rental apartment developments.
Ms. Lottinville handles commercial transactions and has extensive experience in development, purchase and sale of preferred residential properties as well as of age restricted real estate. Ms. Lottinville has drafted complex title documents pertaining to all manner of deed restrictions and easements, including maintenance and development rights and conservation.
